Terms & Conditions – Tribe 365

PD WARRIOR PTY LTD (ABN 31 606 061 723) is the owner and operator Tribe 365 and the related website, app and therapy services. By doing any of the following acts you agree to be bound by these terms and conditions:

  • expressly accepting these terms and conditions at any time, for example by clicking “I Accept” or “Proceed” or any clearly indicated activation phrase on your computer or other device;
  • downloading any of our digital applications (App) or any upgrade to an App offered from time to time; or
  • using the website.

These terms and conditions must be read in conjunction with our Privacy Policy.

The following outlines the terms and conditions of your purchase

Tribe 365: Upon receipt of payment, you have agreed to subscribe to Tribe 365, PD Warrior’s online community, for either 1 month or 12 months.

10 Week Challenge: Upon receipt of payment, you have agreed to subscribe to 10 weekly payments of the 10 Week Challenge. This gives you free access to Tribe 365 during this period and all 10 Week Challenge content only.

Online Gym: Upon receipt of payment, you have agreed to subscribe to the Online gym membership program, for either 1 month, 3 months, 6 months or 12 months with or without our Platinum package.

Safety and disclaimer. If you have experienced any of the following, please consider booking in for a consultation at a local facility or our online coaching service BEFORE joining the online gym or 10 Week Challenge:

  • Fall or ‘near miss’ in the previous 3 months
  • Freezing of gait on a daily basis
  • Unstable cardiac history
  • Recent change in Parkinson’s medications
  • Recent injury, surgery or persistent pain prohibiting free joint movement
  • Used a walking aid indoors
  • Difficulty following instructions

All online programs including Online Gym and 10 Week Challenge have been designed to help you slow your Parkinson’s down, however, we cannot guarantee that you will experience these results as everyone’s presentation is different.

The exercises in the online programs are specific to the symptoms seen in Parkinson’s but remain general in nature. Further tailoring by your PD Warrior Instructor or online coach are recommended to ensure you get the best from the program.

Exercise is not without its risks, and this, or any other exercise program can result in injury. Risks include, but, are not limited to: soft tissue injury, aggravation of a pre-existing condition, adverse effect of over-exertion such as muscle strain, abnormal blood pressure, fainting, loss of balance and falls, disorders of heartbeat, and in very rare instances of heart attack.

To reduce your risk of injury, before beginning this or any exercise program, please consult your PD Warrior Instructor or a health care provider for appropriate clearance and safety precautions. As with any exercise program, if at any point during your workout you begin to feel faint, dizzy, or have a physical discomfort, you should stop immediately and consult your Doctor. Please see your PD Warrior Instructor or health professional as soon as possible if you suspect you may be ill or injured.

At the time of production, the online 10 Week Challenge represented the best of the health, fitness and medical information available. While PD Warrior frequently updates content, we acknowledge that medical, health and fitness information changes with further scientific research.

Cancellation of bookings or memberships
Should you wish to cancel your online gym membership you can do so at any time prior to the next subscription billing cycle. Monthly subscriptions are billed each month on the same day of the month that you made your initial payment. Three month, six month and annual subscriptions are billed accordingly.

Cancellation of online gym membership and/or Tribe membership can be made directly from the platform. If you have any issues with us please email us directly.

Cancellation of online coaching sessions can be made or rescheduled up until 24 hours prior to start time. Appointments cancelled after this time will result in a forfeit of that appointment.

Refund policy
Online gym memberships are non-refundable and will expire 12 months after purchase.

If you have purchased a 10 Week Challenge, you may apply for a full refund up to 30 days from purchase. After this time it will be at the discretion of the director.

For online gym members, there is a two strike policy such that if two classes are booked but unattended your membership will be paused. If it is the first time of non-attendance without cancelling your membership that month, your membership will be resumed, allowing you to book your next class.

This is to prevent members booking out classes and then not showing up, thus preventing other members from attending the class.

For unlimited online gym membership, you are able to pause this, however we’ll need 2 weeks notice to do so.

Online coaching packs are non-refundable and will expire 12 months after purchase. It is important that you use your coaching sessions in this time frame.

Security capabilities and policy for transmission of payment card details
All credit card transactions will be undertaken with best practice security. The PD Warrior PTY LTD website uses secure third-party gateways to collect and store information. Payments are either processed using Stripe or Paypal, which are both secure electronic payment gateways.

Currency
The primary currency listed on the PD Warrior PTY LTD website and the main currency of transaction is in Australian dollars (AUD) and inclusive of GST.

Personal information use and disclosure
PD Warrior PTY LTD complies with all relevant Commonwealth and State legislation governing its operations. For further details, please refer to the Privacy Policy available on the PD Warrior PTY LTD website.

Your rights under law
Your use of the PD Warrior website Tribe 365 platform and the Smart phone App will be subject to certain laws including, without limitation, the Australian Consumer Law. The Australian Consumer Law provides you with certain rights that cannot be excluded, including that services must be rendered with due care and skill and must be reasonably fit for the purpose contemplated. Nothing in these terms and conditions will be read or applied so as to exclude, restrict or modify or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy implied by law (including the Australian Consumer Law) which cannot by law be excluded, restricted or modified.

Tribe 365 Community Guidelines

Overview

The goal of the Tribe 365 community is to share relevant Parkinson’s Disease information and resources, and support fellow members through the highs and lows of their journey with Parkinson’s Disease.

In order to meet the goals of this community, it’s important for members to feel like they are in a safe place that is populated by people with shared interests. As such, we request that you read and adhere to the guidelines that follow.

Guidelines:

  • Respect the privacy and personal information of other members
  • Communicate with courtesy and respect
  • Treat others online as you would treat them in real life
  • Be tolerant towards other’s viewpoints; respectfully disagree when opinions do not align

Please do not:

  • Sell or promote any products or services without the administrator’s prior permission
  • Make personal attacks on other community members
  • Use defamatory remarks or make false statements against others
  • Post prejudiced comments or profanity
  • Bully or make inflammatory remarks to other community members

Consequences:
We will take action when we see someone violating these guidelines. We request that all community members report behaviour that violates our guidelines to a member of the PD Warrior Team.

Agreement:
By logging onto the community and activating your profile, you are considered to be in agreement with the terms and conditions listed above.
